Terms Of Service & Platform Governance
Effective Date: July 25, 2026. By accessing or utilizing Growfitable ("Platform"), you agree to adhere to these binding terms, conditions, and governance rules.
1. Intellectual Property & Cleanroom Code Ownership
All custom source code, CSS design tokens, framework-free PHP architectures, 60FPS UI components, graphic vectors, interactive tools, and editorial material on this site are the exclusive intellectual property of Growfitable.
- ✓Proprietary Systems: You may not copy, reverse-engineer, decompile, scrape, or duplicate our code structures, visual designs, or branding assets without explicit written authorization.
- ✓Client Work Product: Final deliverables developed specifically for contracted client projects are transferred to the client upon full settlement of contract fees under individual SOW agreements.
2. Interactive Tools & Revenue Simulation Models
Growfitable provides interactive calculators, ROI modeling tools, and automated audit simulators (e.g., `/portal`, `/intelligence`, RevOps cost calculators) for informational and diagnostic purposes:
- ✓Simulation Projections: Calculated outputs, estimated revenue lifts, and audit health scores are algorithmic projections based on mathematical models and do not constitute guaranteed financial outcomes or binding quotes.
- ✓Formal Scope Binding: Legally binding scope, pricing, SLAs, and technical deliverables are exclusively defined through official Master Service Agreements (MSAs) and Scope of Work (SOW) documents signed directly with Growfitable.
3. Acceptable Use & Security Perimeter
To maintain platform security, edge latency, and data integrity worldwide, users agree not to engage in restricted activities:
- ✓No Automated Scraping or Attacks: Deploying automated scripts, crawlers, denial-of-service (DoS) attempts, or SQL/XSS injection payloads against Growfitable infrastructure is strictly prohibited.
- ✓Form & Webhook Integrity: Submitting false, spam, or malicious payloads through lead dispatches, WhatsApp webhooks, or audit forms is forbidden and subject to automated IP blocking.
4. Limitation of Liability & Disclaimers
This platform and its public contents are provided on an "as is" and "as available" basis. Growfitable disclaims all warranties, express or implied, regarding search engine algorithm shifts, third-party platform policy changes (e.g., Meta, Google, WhatsApp), or external hosting outages beyond our direct infrastructure controls.
In no event shall Growfitable be liable for indirect, incidental, consequential, or punitive damages arising from the use of public website materials, blog insights, or diagnostic simulators.
5. Governing Law & Legal Contact
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal disputes arising under these terms shall be subject to the exclusive jurisdiction of courts located in Rajasthan, India.
